Job Description

Role: RTA Litigation Fee Earner Location: Wakefield, West Yorkshire Salary: £30,000 - £37,000 Contract: Full time, permanent, hybrid We are working in partnership with a well-established and highly regarded legal services provider to recruit an experienced RTA Litigation Fee Earner to join its growing Personal Injury team. This is an excellent opportunity for a candidate with a strong background in Non-MOJ RTA claims, looking to take ownership of a varied caseload and manage matters through the litigation process from initial instruction through to settlement or trial. The role offers the opportunity to work on non-infant claimant RTA claims, with a focus on providing high-quality legal advice, progressing litigation effectively and achieving the best possible outcomes for clients.

The Role\n

As an RTA Litigation Fee Earner, you will manage your own caseload of Non-MOJ RTA claims, taking responsibility for matters throughout the litigation lifecycle. You will assess the merits of claims, investigate liability and quantum, obtain and review relevant evidence, and develop appropriate case strategies to progress matters towards successful resolution. Your responsibilities will include:

  • Managing a caseload of claimant RTA claims outside of the MOJ Portal.
  • \n
  • Taking matters from initial instruction through to settlement or litigation.
  • \n
  • Assessing liability, causation and quantum and identifying potential issues at an early stage.
  • \n
  • Obtaining and reviewing medical evidence and other supporting documentation.
  • \n
  • Drafting pleadings, witness statements, schedules of loss, Part 36 offers and other legal documentation.
  • \n
  • Preparing cases for litigation and progressing matters in accordance with the Civil Procedure Rules and relevant procedural requirements.
  • \n
  • Liaising with clients, insurers, solicitors, medical experts, Counsel and other third parties.
  • \n
  • Negotiating settlements and working proactively to achieve the best possible outcome for clients.
  • \n
  • Identifying opportunities for interim payments and rehabilitation where appropriate.
  • \n
  • Maintaining accurate case records and ensuring files are progressed efficiently and in line with internal procedures.
  • \n
  • Managing deadlines, prioritising workload and maintaining strong levels of client service throughout.
  • \n

You will play an important role within the wider Personal Injury team, working collaboratively with colleagues while taking ownership of your own caseload and case progression.

About You\n

The successful candidate will have previous experience handling Non-MOJ RTA claims and be confident progressing litigated personal injury matters. You will ideally have experience of managing your own caseload with a good understanding of the Civil Procedure Rules, pre-action protocols and the litigation process. You will also bring:

  • Previous experience handling claimant RTA or personal injury claims.
  • \n
  • Strong Non-MOJ and/or litigated RTA experience.
  • \n
  • Confidence managing claims through the litigation process.
  • \n
  • Good technical knowledge of liability, causation and quantum.
  • \n
  • Strong drafting and negotiation skills.
  • \n
  • Excellent client care and communication abilities.
  • \n
  • Strong organisation and attention to detail.
  • \n
  • The ability to manage deadlines and competing priorities effectively.
  • \n
  • A proactive and commercially aware approach to case progression.
  • \n
  • Confidence working independently whilst contributing positively to a wider team.
  • \n

Experience with case management systems and Microsoft Office is also desirable.
